Terms and Conditions for the Options Pilot Program

Program Participation Agreement between the User and the City of Tallahassee (the “City”).

These Terms of Service constitute a legally binding agreement between the User and the City. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS OF SERVICE, YOU MAY NOT USE OR ACCESS THE PROGRAM. Submission of this form indicates the User's acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). The participation in the City/StarMetro/Dial-a-Ride Options Pilot Program (the “Program”) and use of services constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for reference.

The User understands that the Options Program is a supplemental service for paratransit customers and the services offered exceed the requirements of the Americans with Disabilities Act . Therefore, the City reserves the right to restrict program participation to eligible paratransit customers that fit the program criteria. Users are expected to abide by StarMetro’s customer policies and code of conduct at all times, which are available at Talgov.com/StarMetro. User access to the Program and same-day services can be revoked at any time at the City’s discretion.

The User understands that third-party transportation providers or transportation network companies (“Transportation Companies”), as well as their employees and contracted labor, are not employed by the City nor represent the City. Transportation Companies may require the User to create an account, agree to their terms of service, and require a valid payment method to receive services. Because the Transportation Companies are providing a third-party, self-scheduled service, City employees are unable to assist with scheduling, trip planning, customer service, payment issues, or other requests pertaining to the services provided by the Transportation Companies. Users are encouraged to provide feedback and may opt-out of the Program at any time.

The City may use and share the User’s information to receive same-day transportation services from Transportation Companies. The User’s information may be subject to the City’s compliance with applicable public disclosure laws and subsequently be made public following requests for such information, as provided for by law, including Florida Public Records Law.

User hereby agrees to receive communications from the City or the Transportation Company at any of the phone numbers provided to the Transportation Company by you or on your behalf, and also via email, text message, calls, and push notifications. User agrees that texts, calls or prerecorded messages may be generated by automatic telephone dialing systems. Communications from Transportation Company, its affiliated companies and/or drivers may include but are not limited to: operational communications concerning the User’s account or use of the Transportation Company’s platform, services, or rideshare services, updates concerning new and existing features on the Transportation Company’s platform, communications concerning marketing or promotions run by the City or the Transportation Company, and news concerning the Transportation Company and industry developments. If you change or deactivate the phone number you provided to the City or the Transportation Company, you agree to update your User account information to help prevent any party from inadvertently communicating with anyone who acquires your old number. Standard text messaging charges applied by your cell phone carrier will apply to text messages we send.

IF YOU WISH TO OPT OUT OF PROMOTIONAL EMAILS, CALLS OR TEXT, YOU CAN UNSUBSCRIBE FROM THE PROMOTIONAL EMAILS, CALLS OR TEXT BY FOLLOWING THE UNSUBSCRIBE OPTIONS IN THE TRANSPORTATION COMPANY’S PROMOTIONAL EMAIL, CALL OR TEXT. YOU ACKNOWLEDGE THAT YOU ARE NOT REQUIRED TO CONSENT TO RECEIVE PROMOTIONAL EMAILS, TEXTS OR CALLS AS A CONDITION OF USING THE PROGRAM OR RELATED SERVICES. HOWEVER, YOU ACKNOWLEDGE THAT OPTING OUT OF RECEIVING ALL EMAILS, CALLS OR TEXTS MAY IMPACT YOUR USE OF THE TRANSPORTATION COMPANY’S PLATFORM OR RELATED SERVICES. WHEN YOU OPT OUT EMAILS, TEXTS OR CALLS, YOU MAY RECEIVE A ONE-TIME OPT-OUT CONFIRMATION MESSAGE. NO FURTHER MESSAGES WILL BE SENT, UNLESS INITIATED BY YOU.

The Transportation Companies may use information that the User provides to the City to (i) transmit a request via the Transportation Company’s platform to available drivers; (ii) send automated communications, including but not limited to SMS texts or phone calls relating to transportation services; (iii) share your information with the driver who accepted the request (first name and pick-up and drop-off location only); and (iv) use and store your information for the internal purposes of the Transportation Companies, for the purpose of performing their obligations under the Options Program, subject to each Transportation Company’s Privacy Policy, listed below:

The User consents and authorizes that, upon the City’s request or Transportation Company’s notification, the User’s data is hereby authorized to be released to the City. The City will only request data related to trips eligible for City subsidy that were requested or taken by the User as part of the Program, including but not limited to: trip data, cancelled and incomplete trips, customer service data, and information or reports related to accidents and incidents. User hereby agrees to hold harmless and covenants not to sue the Transportation Company for releasing any and all data requested by the City.

The User agrees that they have read and understood the information provided here and hereby release, waive, discharge and covenant not to hold the City and/or any of the City’s directors, officers, agents and employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or relating to any loss, damage or injury, including death, that may be sustained by you, or to any property belonging to you, while participating in the Program, or in any vehicle, place or places connected where the transportation services are taken pursuant to the Program.
