Electronic Payment Agreement - Terms and Conditions

Please read the following terms and conditions carefully before clicking any of the City of Tallahassee's ("City") electronic payment options. Your use of this payment option constitutes your acceptance of the terms and conditions of this agreement, which may be amended from time to time ("Agreement"). Your use of this payment option constitutes your acknowledgement that You have read this Agreement and have retained a copy for your records.

City refers to the City's owned/operated utilities and its applicable distributors from which you purchased goods and/or services. "You" refers to anyone following the City's link or using mobile applications such as Digitally, to use the Payment Site described below. Funding Account" shall mean any checking, savings, money market or other deposit account in your financial institution from which your payments will be debited or charged. ("e-Bill") refers to the electronic bill from the City. ("e-Payment") refers to any payment You originate from this Payment Site.

  1. Disclosures.

    a. When submitting an electronic payment, You will be linking to and accessing an electronic payment facility web site ("Payment Site") which is owned and operated by Paymentus, which have sole control of, and exclusive responsibility for the security, data, information exchange and any and all transactions on the Payment Site.

    b. Access to, and use of, the Payment Site is subject to any terms and conditions of use, privacy and/or as otherwise set forth on the Payment Site.

    c. By using the Payment Site You will be authorizing Paymentus to electronically debit your Funding Account.

    d. The City, from time to time and without direct, individual notice to You, may revise or update this Agreement, including any fees or charges (if any) related thereto, or cease providing access to the Payment Site at any time. It is your responsibility to read and review the terms of this Agreement each and every time You authorize a transaction.

  2. Responsibility for Payment and Fees.

    a. This electronic payment option is provided for your convenience. You remain fully and directly liable to the City for any amounts and/or fees (including late fees) owed or due to the City. You are solely responsible for ensuring that the payment or payments of any such amounts and/or fees are received by the City. The City will not be liable if any third-party, through whom any e-payment is made, including, but not limited to, the Payment Site or your financial institution if You fail to properly or timely transmit your payment./p>

    b. In addition to any terms and conditions imposed upon through this Agreement and the Payment Site, your use of this electronic payment option may also be affected by other agreements between You and your financial institution. You should review your Funding Account agreements for any applicable fees and other restrictions, which might be impacted by your use of this option as those fees, will continue to apply. There may be fee limitations imposed by your financial institution. You are responsible for being aware of and complying with those limitations.

    c. You are responsible for any and all telephone access fees and/or Internet service fees that may be assessed for your use of the Payment Site. The City is not and shall not be liable or responsible for any system failure, your misdirection of payment, or system error that occurs as a result of your use of the Payment Site.

    d. The payments for the City utility services that You subscribe to are payable by the due date indicated on your utility bill, Digitally or Your e-Bill. Payments made after the statement date on your e-Bill will be reflected on your next utility statement. Amounts owing after the due date are subject to a late payment charge and may result in interruption of services. An additional late payment fee may apply based upon the duration of the outstanding balance. All past due amounts should be paid immediately. Should it become necessary for the City to disconnect a past due account, payment of the full outstanding balance plus a reconnection charge will be required before service is restored.

    e. All payments made using the Payment Site will be applied to the account the same day if made before 5:30 PM EST. Payments made after 5:30 PM EST will be applied the next business day. If services are disconnected and a payment is made after 5:30 PM EST, services will be reconnected the following business day, unless an after-hours reconnect is requested. Additional fees may apply for after-hours reconnects. Future dated payments will be applied on the scheduled date or the next business date immediately following the future date.

    f. The City reserves the right to obtain financial information regarding your Funding Account from the Payment Site (for example, to resolve payment-posting problems or for verification). By your use of the Payment Site, You authorize Paymentusto electronically debit your Funding Account pursuant to a transaction initiated through City billing. In addition, You authorize the City to electronically debit your Funding Account for any fees assessed by your financial institution and incurred by the City and/or the Payment Site as a result of insufficient funds, closed account or the payment being rejected due to misrepresentation of account or data entry error in your Funding Account, up to the maximum amount permitted by law

    g. Digitally, e-Bill and the Payment Site use a secure server that implements secure sockets layer (SSL) technology in the encrypted email process to protect your payment information. As an additional protection for You, the Payment Site is designed so that You cannot make a payment until You are safely within secure mode. We recommend that You do not communicate your payment information details to anyone, including the City, by phone or methods outside of the encrypted email.

    h. The City shall not be liable if the Payment Site causes an incorrect amount of funds to be removed from your Funding Account or causes funds from your Funding Account to be directed to a payee, which does not comply with your instructions.

  3. Exclusion of Warranties

    The City makes no representations and/or warranties of any kind regarding the e-Bill or e-Payment options, Digitally, and/or the Payment Site, whether expressed or implied, including, but not limited to, any implied warranties of merchantability and fitness for a particular purpose.

  4. Limitation of Liability

    The City is not and shall not be liable or responsible for any system failure, your misdirection of payment, or system error that occurs as a result of your use of the Payment Site. In no event will the City be liable to You for loss of or damage to records or data; inaccurate data, cost of procurement of substitute goods, services or technology; any matter beyond its reasonable control; or any direct, indirect, special, incidental or consequential damages arising out of this agreement or your use of the City e-payment, Digitally, the Payment Site or any equipment or software required to use the City e-Bill or e-Payment or the Payment Site, including but not limited to loss of profits, even if the City has been advised of the possibility of such damages.
